PRIMARY PURPOSE OF POSITION
The position is an executive regulatory affairs position for Exelon.  The Director, Federal Regulatory Affairs – Utilities will report to the Director, Federal Regulatory Affairs and will focus primarily on transmission and related matters affecting the Exelon utilities.  The primary purpose of this position is to support the Director, Federal Regulatory Affairs in providing centralized management of Exelon’s federal regulatory advocacy, including communication with FERC, internal development of positions, participation in proceedings, preparation and filing of pleadings and informal advocacy.  This includes centralized management and tracking of FERC commitments for Exelon’s transmission-owning utilities.  The position identifies relevant emerging FERC issues and timely communicates with corporate and business unit executives, as appropriate.  The position provides leadership, strategic direction and management of internal and external legal and other resources as necessary to support federal policy and regulatory development and advocacy.


PRIMARY DUTIES AND ACCOUNTABILITIES
In coordination with the Director, Federal Regulatory Affairs and with a focus on transmission and related aspects of Exelon’s business:

  • Perform the primary communication function with FERC Commissioners and staff and other federal agencies, as appropriate, and manage all communications from company officials to FERC and other federal agencies.  This includes providing relationship management of Exelon executives with regulatory policy makers.
  • Direct and manage all company participation in docketed cases at FERC and other federal agencies as appropriate, including rulemakings, pleadings and participation in settlement conferences.  This includes drafting, reviewing signing off on filings at FERC and maintaining a system for tracking and monitoring these activities with these agencies. 
  • Direct and manage the review of FERC issuances and filings to identify and analyze business implications of relevant FERC dockets and to coordinate company-wide responses.
  • Coordinate the communication regarding FERC and other federal policy matters, as appropriate especially related to the company’s transmission interests. 
  • Collaborate in pursuing broad advocacy on issues related to federal policy of interest to the company, such as in the NARUC arena.
  • Collaborate in participating in trade associations and other transmission-owning utilities to leverage our memberships to further the company’s interests.
  • Manage and ensure that the company performs all commitments to FERC and other federal agencies, as appropriate, including maintaining a system for tracking and monitoring such commitments. 

POSITION SCOPE

  • Reports to the Director, Federal Regulatory Affairs (although this is expected to change if Exelon successfully "spins off" its generation and trading business units).
  • Supports the Senior Vice President, Regulatory Policy and Analysis.
  • Maintain and coordinate the company’s presence at FERC and other federal agencies.  Most of the company’s essential, non-distribution regulatory activities are regulated by FERC, including accounting for public utilities, transmission rates, planning, interconnection, cost allocation and related matters, wholesale sales of electricity, wholesale sales and purchases of natural gas and affiliate transactions of all types and communications about those transaction to FERC itself, to internal business units and to unaffiliated business partners.  The company’s positions on policy issues must be coordinated across all business units to ensure that the company’s overriding business interests prevail.  In addition, the company’s communications with FERC must be coordinated to ensure consistent and constructive interface across all subject areas.  An employee who understands the FERC processes and is known and respected by FERC personnel is essential to manage these crucial regulatory interfaces.
  • Performs as the lead for federal regulatory proceedings, filings, pleadings and settlement negotiations.
  • Consults with the company’s and business units’ executive leadership in providing assessments of the regulatory landscape and implications and in the development of appropriate business responses and strategies.
  • Interfaces with executives, academics, and other senior-level personnel in the energy industry and with senior federal and state regulators and their staffs.

Qualifications

 

POSITION SPECIFICATIONS

Minimum:

  • Four-year degree and a minimum of 12 or more years' experience specializing in FERC regulation of natural gas and electric utilities. Such experience will include policy development, administrative litigation, and appellate litigation involving FERC matters.
  •  Strong relationships with FERC officials preferably based upon a successful career at FERC, at both the commissioner and senior staff level.
  • Excellent writing skills to ensure that company's communications and pleadings at FERC and before other federal agencies are well written and effective.
  • Excellent oral skills to routinely communicate with corporate leadership and with agency commissioners and staff.
  • Strong interpersonal skills to provide effective liaison function between company and FERC and other regulatory officials.
  • Strong consultative skills to work within the corporation to lead and direct cross-functional teams in assessing the implications of rulemakings, policy changes, and to develop appropriate responses.
  • Ability to negotiate with a broad spectrum of parties.
     

Preferred:

  • Law degree or Master’s Degree in Science, Engineering, Economics, Public Policy, Government Administration or Business.
  • 12 or more years as a senior industry analyst, policy advisor or similar position, specializing in FERC regulation of electric utilities. 
  • Senior level position with responsibility for advising on or advocating for FERC-related issues.
  • Understanding of transmission tariffs and rules and markets, preferably in the PJM region.
  • Familiarity and prior experience working with national trade organizations.
  • Familiarity with and prior experience in RTO stakeholder processes.
  • Experience with natural gas regulatory and NERC matters.
  • Experience with matters involving the Department of Energy.
